TERMS OF SALE

General Provisions

These conditions govern purchases made on the website www.pasquinicalzature.it of Pasquini Srl in accordance with the provisions of Part III, Title III, Chapter I, of the Consumer Code, Legislative Decree No. 206/2005, as amended by Legislative Decree No. 21/2014 and Legislative Decree No. 70/2003 on electronic commerce.

In these sales conditions, “Pasquini” and “we” refer to the company Pasquini Srl, with its registered office at Via del Marginone, 98, 55012 Capannori (LU), VAT No. 01430200467.

By sending the confirmation of their purchase order, the buyer declares to have examined and unconditionally accepted these general sales conditions and agrees to comply with them in their relationship with the seller. The customer is required, once the online purchase procedure is completed, to print and retain these general sales conditions in order to fully satisfy the requirements of Article 53 of Legislative Decree No. 206/2005.

Purchase Methods

The products presented on the website www.pasquinicalzature.it can be purchased by selecting the items of interest and adding them to the virtual shopping cart. After completing the product selection, the consumer will be invited to provide the required shipping information in order to complete the purchase.

The purchase of products, available as shown and described online in their respective product pages, will be made by the customer at the price indicated at the time of order confirmation, plus the shipping costs shown during the purchase process.
Before confirming the purchase, the customer will see a summary of the unit price of each selected product, the total cost if purchasing multiple products, and the associated shipping costs.
By confirming the purchase, the customer will receive an order confirmation email containing the date, total amount of the order, and the delivery address to which the goods will be sent. The customer agrees to verify the correctness of the personal data contained in the confirmation email and to promptly notify Pasquini of any necessary corrections.

Product Availability

We will make every reasonable effort to ensure that prices and other product information on the website are accurate and up-to-date. However, listing any product on our website does not imply, ensure, or guarantee that the product will be available for purchase through the order process.
If a customer places an order for a product that is out of stock, they will receive an email from Pasquini within 5 days of order receipt, notifying the cancellation of the order. The amount paid by the customer will be refunded.

Prices and Payments

The prices of the products are indicated on the website and will be confirmed on the order checkout page and in the order confirmation, as well as in the invoice. We reserve the right to change the prices of our products at any time. However, we will not alter the price of any product after the order confirmation has been sent. All prices include VAT as applicable.

The customer must pay for the products purchased and related shipping fees at the time of order confirmation, using one of the payment methods indicated on the order form: PayPal or advance bank transfer.

Payment via PayPal:
With Credit Card, Prepaid Card, or PayPal Account.

If the customer chooses PayPal as a payment method, they will be redirected to www.paypal.it, where the payment will be processed according to PayPal’s terms and conditions.
The data entered on the PayPal site will be processed directly by PayPal and will not be shared with Pasquini, preventing Pasquini from accessing or storing the credit card details linked to the customer’s PayPal account or any other payment method linked to it.

Using PayPal as a payment method, by clicking “Proceed to PayPal”, you will be redirected to PayPal’s secure server, where you can:

  • Pay safely using your PayPal account, if you have one

  • Pay directly with your credit card.

Once the online transaction is completed, PayPal will immediately charge the amount for the purchase.

Under no circumstances can Pasquini be held responsible for fraudulent use of credit cards by third parties during the payment for products purchased on the website www.pasquinicalzature.it.

If you do not have a PayPal account, you can pay directly with your credit or prepaid card using PayPal as the payment method, then by clicking on “Don’t have a PayPal account?”

Payment by Advance Bank Transfer

If the payment method chosen is bank transfer, you will receive an email with the bank details to make the transfer.
Proof of payment by bank transfer must be sent via email to the address specified in the order summary before confirming the order. We will not process the order until payment has been received, verified, and collected by the banking system.

Shipping Fees

Shipping fees will be calculated based on the total order amount according to the following table:

  • Italy (excluding islands): €7

  • Calabria, Sicily, and Sardinia: €10

  • Austria, Belgium, Denmark, France, Germany, Luxembourg, Netherlands, Poland, Portugal, Czech Republic, Slovakia, Spain, Hungary: €12

  • Bulgaria, Croatia, Estonia, Latvia, Lithuania, Romania, Slovenia, Sweden: €17

  • Cyprus, Finland, Greece, Ireland, Malta: €25

Orders over €150: Free shipping.

Product Delivery Methods

Pasquini commits to delivering the products ordered by the customer using couriers to the address specified during order registration. Pasquini is not responsible for delays in processing the order or in the delivery of the ordered goods.

If the carrier is directly chosen by the customer, Pasquini will not be responsible for any loss, damage, or spoilage of the goods once they are delivered to the carrier at our warehouses.

Delivery Times:
For domestic deliveries, except for unforeseen circumstances, the delivery time will be 24/48 hours, and 72 hours for hard-to-reach locations such as Calabria, Sardinia, Sicily, and smaller islands. During August, deliveries may experience delays due to the company’s summer closure.
International delivery times vary from 7 to 10 days.

Upon receiving the product, the customer must check that the package is perfectly intact. The customer must sign with a specific reservation (specifying the type of damage).

The customer can file a complaint within 8 days from delivery.

If the recipient is absent at the delivery address, the courier will attempt a new delivery the next day (it is not possible to specify a particular day or time for delivery). If delivery is impossible the following day due to the absence of the recipient, the courier will attempt to contact the customer to reschedule the delivery. If customer service is unable to contact the customer within the next five days or if the delivery is still not possible, the products will be returned to www.pasquinicalzature.it. If there is a change in the delivery address after the shipment, any extra fees applied by the courier will be borne by the recipient.

Insurance

We insure every order in transit until delivery and require a signature upon receipt of each product delivered. Once the product is signed for at the address you provided, we are no longer responsible for the proper execution of the order.

Right of Withdrawal – Returns and Refunds

In accordance with the legal provisions in force, the customer has the right to withdraw from the purchase within 14 days from the date of receipt of the products. To exercise the right of withdrawal, the customer must notify Pasquini with an explicit statement, which can be sent by registered mail.
In case of exercising the right of withdrawal, the customer must return the goods within 14 days from the day they communicated their intention to withdraw from the contract, in accordance with Article 57 of Legislative Decree No. 206/2005.

The goods must be returned intact, in the original packaging, complete with all parts, and with the attached fiscal documentation. Pasquini will proceed to refund the amount of the returned products (excluding packaging and shipping fees, as provided by Italian law) after verifying that the conditions have been met.

Pasquini will refund the amount paid by the customer once the returned product is received. The refund will be made via credit to the customer’s bank account or credit card used at the time of the transaction or via PayPal. The refund will not incur any additional costs for the customer.

Pasquini will not refund any shipping costs or packaging costs for the return shipment.

International orders are not eligible for free returns or exchanges; return shipping and handling fees will be deducted from the refund. Original shipping costs are non-refundable.

Applicable Law and Jurisdiction

These General Terms and Conditions of Sale are governed by Italian law.

Any disputes that cannot be resolved amicably will be subject to the exclusive jurisdiction of the Court of Lucca.
